## Carrier Liability

**Carrier liability** is the moving carrier’s legal responsibility for loss or damage to a shipment under applicable law and the transportation contract. The extent of that responsibility depends on the move, the selected valuation terms and the facts of the loss.

### In plain English

It concerns what the carrier may owe when goods are lost or damaged while it is responsible for them. A protection selection sets relevant terms; it does not by itself establish the cause of damage or the amount payable on a particular claim.

### U.S. interstate household-goods moves

[49 CFR 375.201](https://www.ecfr.gov/current/title-49/section-375.201?ref=relocationecosystem.com) generally makes the carrier liable for loss or damage during transportation and related services identified on its lawful bill of lading. The rule describes Full Value Protection and a written waiver to the released-value framework, and requires clear disclosure of liability limits.

[FMCSA’s consumer guidance](https://www.fmcsa.dot.gov/protect-your-move/valuation-insurance?ref=relocationecosystem.com) explains that [Full Value Protection](https://relocationecosystem.com/full-value-protection/) applies unless the customer chooses [Released Value](https://relocationecosystem.com/released-value/). Confirm the signed choice, declared shipment value, any deductible and required high-value-item disclosures before the move.

### Liability is different from insurance

[Valuation](https://relocationecosystem.com/valuation/) describes the mover-liability choice. Separate insurance is governed by its policy and insurer. Ask for the actual policy or evidence of coverage when insurance is sold or procured; do not treat a provider’s general statement that it is insured as proof of the protection selected for your belongings.

### Responsibility and handoff

- The customer and carrier should retain the signed contract and valuation selection.
- Operations and handling teams need the current inventory and disclosed handling requirements.
- At pickup, storage and delivery handoffs, preserve dated condition observations and item-linked photographs.
- The customer or authorized claimant submits the formal claim to the proper carrier and retains proof of receipt.

A condition record supports the evidence. It does not automatically establish fault, waive rights or complete a formal claim. For claims governed by [49 CFR 370.3](https://www.ecfr.gov/current/title-49/section-370.3?ref=relocationecosystem.com), delivery damage notations alone do not satisfy filing requirements.

### Jurisdiction and service boundaries

Intrastate moves, international transport, storage and separately hired services may involve different rules or contracts. Identify the responsible provider and applicable terms for each stage rather than assuming one protection arrangement covers every service.
